Distance sales agreement

1. The parties

Buyer: the holder of the BadgerMecX account that places the order, with the name, e-mail address and billing address entered at checkout.

2. What is sold

Pro access to the calculators at badgermecx.com/calculators/ for the period chosen at checkout (one month or one year): the calculators marked Pro, the step-by-step working and the saved and exported reports, as described on the Pro page at the time of the order. It is a digital service. Nothing is shipped.

3. Price and payment

The price is the one shown on the order summary before you pay, in Turkish lira, [VAT included]. It is charged once, by card, through iyzico Ödeme ve Elektronik Para Hizmetleri A.Ş. Your card details go to iyzico and are never seen or stored by us.

No automatic renewal. The purchase is for one period. Nothing is charged again unless you buy again.

4. Delivery

Pro access is switched on in your account as soon as the payment is confirmed, normally within a few minutes, and runs until the end date shown in your account. If it is not switched on within [24 hours], write to info@badgermecx.com and we will switch it on or refund you.

5. Right of withdrawal

Under Article 15(1)(ğ) of the Turkish Distance Contracts Regulation, the right of withdrawal does not apply to services performed instantly in an electronic environment. At checkout you ask us to start the service at once and confirm that you know you lose the right of withdrawal when it starts. [Wording and scope to be confirmed by counsel.]

6. Our obligations and yours

We provide the service as described and keep it available as far as reasonably possible; the calculators are for education and preliminary sizing, as set out in the Terms & conditions, which are part of this agreement. You keep your login to yourself — a Pro account is for one person — and use the service lawfully.

7. Records

This agreement and the information before it are shown to you at checkout and accepted there. [A copy is sent to your e-mail address after payment.] We keep the order record for as long as the law requires.

8. Complaints and disputes

Write to info@badgermecx.com first. If we cannot settle it, you may apply to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) or the Consumer Court (Tüketici Mahkemesi) where you live or where the service was bought, within the monetary limits set each year by the Ministry of Trade.

2. Konu. badgermecx.com/calculators/ adresindeki hesap araçlarına, ödeme sırasında seçilen süre (bir ay ya da bir yıl) için Pro erişim: Pro işaretli hesap araçları, adım adım çözüm ve kaydedilen/dışa aktarılan raporlar; sipariş anında Pro sayfasında anlatıldığı şekliyle. Elektronik ortamda sunulan bir hizmettir, fiziksel teslimat yoktur.
3. Bedel ve ödeme. Bedel, ödemeden önce sipariş özetinde gösterilen, Türk lirası cinsinden tutardır [KDV dahil]. Tek seferde, kartla, iyzico Ödeme ve Elektronik Para Hizmetleri A.Ş. aracılığıyla tahsil edilir; kart bilgileri iyzico'ya gider, tarafımızca görülmez ve saklanmaz. Otomatik yenileme yoktur: satın alma tek bir dönem içindir; yeniden satın alınmadıkça tekrar tahsilat yapılmaz.
4. İfa. Pro erişim, ödeme onaylanır onaylanmaz, genellikle birkaç dakika içinde, alıcının hesabında açılır ve hesapta gösterilen bitiş tarihine kadar sürer. [24 saat] içinde açılmazsa info@badgermecx.com adresine yazılması hâlinde erişim açılır ya da bedel iade edilir.
5. Cayma hakkı. Mesafeli Sözleşmeler Yönetmeliği'nin 15. maddesinin birinci fıkrasının (ğ) bendi uyarınca, elektronik ortamda anında ifa edilen hizmetlerde cayma hakkı kullanılamaz. Alıcı, ödeme sırasında hizmetin hemen başlatılmasını talep eder ve hizmet başladığında cayma hakkını kaybedeceğini bildiğini onaylar. [Metin ve kapsam hukuk danışmanınca teyit edilecektir.] Buna rağmen yaptığımız iadeler Teslimat ve İade Şartları sayfasındadır.
6. Yükümlülükler. Satıcı hizmeti anlatıldığı şekilde sunar ve makul ölçüde erişilebilir tutar; hesap araçları Kullanım Koşulları'nda belirtildiği üzere eğitim ve ön boyutlandırma içindir ve bu koşullar sözleşmenin parçasıdır. Alıcı giriş bilgilerini kimseyle paylaşmaz — Pro hesap tek kişiliktir — ve hizmeti hukuka uygun kullanır.
7. Kayıt. Bu sözleşme ve ön bilgilendirme ödeme sırasında alıcıya gösterilir ve orada onaylanır. [Ödemeden sonra bir kopyası alıcının e-posta adresine gönderilir.] Sipariş kaydı yasal süre boyunca saklanır.
8. Uyuşmazlıklar. Önce info@badgermecx.com adresine yazılması rica olunur. Çözülemeyen uyuşmazlıklarda alıcı, Ticaret Bakanlığı'nca her yıl ilan edilen parasal sınırlar içinde, yerleşim yerindeki ya da hizmeti satın aldığı yerdeki Tüketici Hakem Heyeti'ne veya Tüketici Mahkemesi'ne başvurabilir.
